About us

The State Agency “Insolvency Administration” is a state authority subordinated to the Ministry of Justice and established in 2002 in accordance with the Law on Public Agencies, the Law “On protection of employees in case of insolvency of the employer”, the Law “On the insolvency of enterprises and business companies” and other normative acts.

The tasks of the Insolvency Agency include ensuring of the implementation of Government policy in the matters of insolvency proceedings, protection of the interests of employees in case of employers’ insolvency, and pursuing of the interests of the state and society in the matters of insolvency.

The Insolvency Administration is entrusted with training of candidate administrators, certificating and supervising administrators and recommends administrators to the Court. Administrators of insolvency proceedings are entitled to satisfy quickly the claims of employees and claim from the Insolvency Administration funds from guaranty fund established for employees’ claims.

Administrators are subject to registration and regular control of their activities related to certain insolvency proceedings in order to ensure competence and transparency of the insolvency proceedings.

Pursuant to the Law On Protection of Employees in the Case of Employer’s Insolvency, the Insolvency Administration holds and manages the assets of guarantee fund for employees’ claim, examines and satisfies the employees’ claims summarized by the administrators. Employees are entitled to satisfaction of their claims regardless of whether or not the employer has made the statutory payments. The Insolvency Administration is implementing the state guarantees in respect of employees, thus protecting the employees’ rights to equitable remuneration and compensation of their work.
