An unjustifiably updated or re-drafted record of the register of civil status records or newly drafted entry of the register of civil status records, if it is incomplete, and if the annulment of the entry of the renewed or re-compiled register of civil status acts would have adverse legal consequences for the person, the Ministry of Justice shall, on the basis of a judgment of the court or a decision of the Ministry of Justice.
The entry of the register of civil status records may be cancelled if it has been drawn up in the local government's correspondence department or in the diplomatic and consular representation of the Republic of Latvia in a foreign state.
The State fee for the annulment of the register of a civil status act shall be EUR 7 (to be paid when submitting an application).

Process description

  1. Submission of an application for annulment of the entry of the register of civil status records
    The documents necessary for the cancellation of the entry of the register of applications and civil status records shall be submitted to any division of the local government's family lists or to the nearest diplomatic and consular representation of the Republic of Latvia in a foreign state. The application shall be submitted by a person for whom the relevant record has been made or by his or her authorised person or by a person who justifies his or her legal interest.

  2. Necessary documents for cancelling the entry of the register of civil status records
    The application for the cancellation of the entry of the register of civil status records must be accompanied by:
    1) a document attesting that the record of the register of civil status records has been restored or recommitted;
    2) a document attesting that the initial entry of the register of civil status records has been retained;
    3) a document regarding the change of surname, if the surname of the submitter in the personal identification document does not conform with the surname in the first entry or the updated entry of the register of civil status records or the re-entered entry of the register of civil status statements;
    4) the list of biographical data of the submitter, if the record of the civil status record to be rescinded refers to him or her;
    5) documents which prove that the submitter falls within the circle of the heirs of the deceased person, if the record of the civil status record regarding the fact of the death of the person is to be rescinded;
    6) an explanation if there are conflicting information in the updated or re-committed register entry and the pre-entry.
    The local government family list department or diplomatic or consular representation of the Republic of Latvia in foreign states shall send the documents necessary for the cancellation of the entry of the civil status register to the Ministry of Justice's Dzimtsaraksts department for the taking of a decision.

  3. Adoption of a decision regarding an authorisation or refusal to cancel an entry in the register of c
    The Department of Justice Dzimtsaraksts shall take a decision regarding a permit or refusal to cancel a record of civil status records within a period of one month from the date of receipt of the application in the Department of Dzimtsaraksts of the Ministry of Justice.
    A decision regarding the annulment of an entry in the register of civil status states or the refusal to cancel it shall be sent to the person by post in a registered letter to the indicated correspondence address or declared place of residence. The decision will enter into force at the time it has been notified to the addressee or on the seventh day after it has been posted.
