On 10 – 12 June, 2015 in Jūrmala, in „Baltic Beach Hotel” took place the closing conference of Civil Justice Program of the European Union Project JUST/2013/JCIV/AG/4691 „The Court of Justice of the European Union and its case law in the area of civil justice”.

The conference was opened by the Minister of Justice Dzintars Rasnačs.

During the conference was presented research “The Court of Justice of the European Union and the impact of its case law in the area of civil justice on national judicial and administrative authorities” and Recommendations and Guidelines (hereafter – guidelines) „Effective adoption, transposition, implementation and application of European Union legislation in the area of civil justice” that were conducted within the project. The research and guidelines were conducted by Inga Kačevska Law Office, in close cooperation with experts from Ministry of Justice of Latvia and foreign partners of the project.

During the conference were presented lectures on procedures of the Court of Justice of the European Union and on preliminary ruling, including topics like role of national courts in application of EU law and case law of Court of Justice of the European Union in the area of civil justice.

In the conference as lecturers participated legal experts from Latvia, Hungary and United Kingdom: Aleksandra Melesko, lecturer at Riga Graduate School of Law, guest lecturer at Academy of European Law and European Institute for Public Administration, consultant of the European Affairs Committee of the Saeima on Latvian presidency issues, former legal secretary at the Chambers of Judge Sir Konrad Schiemann, CJEU, Guntars Precinieks, Sworn advocate, lecturer at University of Latvia Faculty of Law, Ildikó Németh, Legal Adviser at Ministry of Justice of Hungary and Barbara Fontaine, the Senior Master of the Senior Courts of England & Wales Queen’s Bench Division of The Royal Courts of Justice.

In addition the participants of the conference took part in workshops “European procedures” – regulations No 1896/2006 (European order for payment procedure) and No 861/2007 (European Small Claims Procedure) - application in practice, filling in the forms, European e-Justice portal; „General civil law, jurisdiction, applicable law, recognition and enforcement of judgments” – regulations No 1215/2012 (Brisele I bis, before – regulation No 44/2001), No 864/2007 (Roma II), No 593/2008 (Roma I) and application in practice of relevant international conventions, used autonomous concepts and history of development of above mentioned regulations); „Family matters, jurisdiction, applicable law, recognition and enforcement of judgments, as well civil aspects of cross-border child abduction„ – application in practice of regulations No 2201/2003, No 1259/2010 and relevant international conventions and in „International cooperation, service of cooperation, taking of evidence” – application in practice of regulations No 1393/2007 and No 1206/2001. The workshops were moderated by justice sector experts from Latvia, namely Sandris Laganovskis, Director of the Patent Office of the Republic of Latvia, Anita Zikmane, Assistant of the Chief Justice of the Supreme Court of Republic of Latvia on EU law issues, Irēna Kucina, Deputy State Secretary on Court issues of the Ministry of Justice of the Republic of Latvia and Zane Pētersone, the judge at the Department of Civil Cases of the Supreme Court of the Republic of Latvia.

In the conference participated delegations of project partners from public administration, Ministry of Justice and Hungarian Office for the Judiciary of Hungary, Austrian Federal Ministry of Justice, Ministry of Justice of the United Kingdom, as well representatives of Ministry of Justice of Latvia, courts of general jurisdiction, administrative courts and the Supreme Court, Council of Sworn Advocates, Foreign Affairs Committee of the Saeima, Legal Aid Administration, University of Latvia, Insolvency Administration, Council of Sworn Notaries, Council of Latvian Sworn Bailiffs, Latvian Judicial Training Centre and Maintenance Guarantee Fund.

The implementation of the project was started on 1st of March, 2014. The aim of the project is to remove obstacles in EU civil justice area, analyzing application of EU law in the field of civil justice at the national level, as well as to contribute proper application of CJEU case-law in the decisions and judgments of national courts and in drafting national legal acts. The implementation of the project will be finished on 31st of August, 2015.
